These Terms of Service ("Terms") constitute a legally binding agreement between you and Jtek ("Jtek," "we," "us," or "our") governing your access to and use of the Jtek platform, website, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, do not use the Service.
The Service is intended for use by licensed real estate professionals, real estate teams, and brokerages. You agree to use the Service only for lawful purposes and in accordance with these Terms.
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. Notify us immediately at security@jtek.pro if you suspect unauthorized account access.
You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement.
To access the Service, you must create an account and provide accurate, current, and complete information. You agree to keep this information updated throughout your use of the Service.
Each account is for use by one individual. You may not share your login credentials with others or create accounts on behalf of other users without proper authorization. Team and multi-seat plans are available for organizations needing multiple users.
Jtek offers monthly and annual subscription plans. Subscription fees are billed in advance on a recurring basis. You authorize Jtek to charge the payment method on file for all fees due.
Annual subscriptions are non-refundable except where required by law or at our sole discretion. Monthly subscriptions may be canceled at any time and will remain active through the end of the current billing period.
We reserve the right to change subscription pricing with 30 days' advance notice. Continued use of the Service after the price change takes effect constitutes your agreement to the new pricing.
If a payment fails, we will notify you and attempt to reprocess the charge. Access to the Service may be suspended for accounts with overdue balances after a 7-day grace period.
You agree not to use the Service to:
The Service, including all software, content, design, and technology, is owned by Jtek and protected by applicable intellectual property laws. These Terms do not grant you any rights to Jtek's intellectual property other than the limited license to use the Service as described herein.
You retain ownership of all data, contacts, and content you upload to the Service ("Your Content"). By using the Service, you grant Jtek a limited, non-exclusive license to process Your Content as necessary to provide the Service to you.
To the maximum extent permitted by applicable law, Jtek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service.
Jtek's total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to Jtek in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
You may cancel your subscription and terminate your account at any time through the account settings page or by contacting support. Cancellation will take effect at the end of the current billing period.
Jtek may suspend or terminate your account immediately if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use of the Service poses a risk to other users or the platform's integrity.
Upon termination, your right to access the Service ceases immediately. We will retain your data for 90 days following termination, after which it may be permanently deleted.
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
